Innovate Commercial Real Estate LLC

Website Privacy Notice

Effective October 14, 2026

Introduction

Innovate Commercial Real Estate LLC (“Innovate CRE,” “we,” or “us”) provides commercial real estate brokerage services and operates a website and client portal through which prospective and existing clients may supply information to evaluate potential purchases and leases of commercial property. This notice explains our practices regarding information collected through those services. Effective date: October 14, 2026.

Information we collect

We may collect names, business names, business contact details, portal account and authentication information, property preferences, purchase and rent budgets, self-reported net worth and liquidity, self-reported credit scores or other voluntarily supplied credit information, personal or business financial statements, tax returns, bank and brokerage statements, beneficial ownership information, identity information, transaction records, communications, meeting recordings, and portal activity or technical logs. We may receive information from you, your authorized representative, transaction participants, or the systems you use to interact with us. We do not presently order consumer credit reports from consumer reporting agencies.

Why we use information

We use information to establish and manage your account, evaluate self-reported or documented financial qualifications for direct commercial property purchases or leases, identify and communicate suitable current or future properties, coordinate brokerage activities, conduct due diligence, protect the portal, maintain legally required records, respond to requests, and comply with legal obligations. We may retain a general financial qualification category and basic property preferences for future commercial property opportunities when authorized by our agreement with you.

Sharing of information

We may share general, accurately characterized financial qualifications with a seller, landlord or the applicable broker when reasonably necessary to consider a proposed transaction, subject to brokerage confidentiality obligations. We will seek a separate, specific written or electronic authorization identifying the documents, recipients and transaction before disclosing underlying financial documents to a prospective transaction counterparty. We may share information with your authorized advisors and relevant lenders, escrow and title providers, inspectors and other transaction professionals as appropriate, and with vendors that host, transmit, store or process information for our operations. We may also disclose information as legally required or to protect our rights. We do not sell client financial or personal identifying information.

Closed-transaction publicity

If permitted by our Confidentiality and Information Use Agreement with the client, Innovate CRE may publicize the client’s name and business, completed property transaction address and type, sales price or rent, price or rent per square foot, property size, business type, transaction timing and other general deal terms after the transaction closes or the lease is executed. Underlying financial documents and sensitive identifying information are excluded, and restrictions arising from law or enforceable third-party confidentiality duties remain applicable. Clients may communicate a restriction before publication as described in that agreement.

Service providers and AI transcription

Our portal, cloud storage, electronic signatures, communications and customer management functions may involve third-party providers. Some meetings or calls involving Innovate CRE may be recorded, transcribed or summarized using automated tools as allowed by applicable law. Providers handle information in accordance with their terms and practices and applicable law. We select and oversee providers under our applicable security obligations; we do not promise to control every use, internal access method or retention practice of an independent vendor.

Safeguarding and retention

We maintain reasonable safeguards appropriate to the sensitivity of personal identifying information and the nature and size of our business. No website or electronic system is guaranteed to be free from security risk. We retain brokerage transaction records for required legal periods, generally four years under Colorado Real Estate Commission Rule 6.20 for covered transaction files, and review other financial information for deletion or secure disposal when it is no longer reasonably needed. Limited general qualification categories may be retained for later opportunities; backup copies may remain during routine backup cycles; preservation obligations may apply to disputes or legal holds.

Communications

We may email clients about relevant commercial properties and brokerage services, subject to applicable law and available opt-out rights. Promotional email recipients may opt out through the method in the message or by contacting us. Consent to the website terms does not authorize marketing robotexts or calls when additional consent is required.

Requests and inquiries

You may contact us to update information, correct material inaccuracies, request cessation of promotional communications, or request return or deletion of information not subject to an ongoing permitted use or legal retention obligation. Certain rights or limits may apply depending on the information and applicable law. We may need to verify identity or authority before responding.

We may update this notice from time to time. We will post the updated version and its effective date. An update does not by itself change contractual obligations in an agreement already accepted.
